JINSA Report #872 March 31, 2009 Omar Bashir in Qatar The IDF Spokesman's Office reported this week: According to the data gathered by the Research Department of the Israel Defense Intelligence, there were 1166 names of Palestinians killed during Operation Cast Lead. 709 of them are identified as Hamas terror operatives, amongst them several from various other terror organizations. Furthermore, it has been found that 295 uninvolved Palestinians were killed during the operation, 89 of them under the age of 16, and 49 of them women. In addition, there are 162 names of men that have not yet been attributed to any organization. Has any army been so careful to document casualties on the other side of a defensive operation? Has any army been so precise in an attack on a cowardly terrorist force that removed its uniforms, hid weapons in mosques and fired from among its own women and children? And yet large parts of the world seem convinced that Israel went on an unchecked rampage in Gaza and there is movement afoot to charge Israeli government and military officials with crimes at the International Criminal Court (ICC). But what happens when there is a real unchecked rampage? Omar Bashir of Sudan was indicted by the ICC for war crimes against the people of Darfur. It was little enough for the Court to do; the UN estimates that 300,000 people have been killed and 2.7 million driven from their homes since 2003 in attacks by militias supported by the Government of Sudan. After the indictment, Bashir ousted several NGOs that feed and care for the refugees. Inter alia, the indictment forbids Bashir's travel and requires member governments to arrest him upon entry to their countries. No country of the 22-member Arab League is a signatory to the ICC - with which we take no particular issue - so it is not surprising that he was not arrested upon entering Qatar. But that was insufficient for the League - which issued a formal declaration rejecting the indictment and welcomed Bashir as a hero. On the other hand, Arab League Secretary General Amr Moussa said at the summit that Israel should be held accountable for "war crimes" in Gaza. JINSA's objections to the ICC are old and grounded in our belief that the Court is inconsistent with American Constitutional protections and would produce political indictments of Israel and the United States at the first possible opportunity. They have not changed just because the Court had a moment of sanity in the indictment of Bashir.   More interesting is the fact that Muslim Arab governments are willing to crony up a brutal dictator and turn their backs on hundreds of thousands of their Muslim brothers penned up in refugee camps, festering there with only outsiders to feed them. And crony up further when the "international community" finds its voice to object. Sort of like the Arab treatment of the Palestinians in refugee camps in Lebanon, Syria and Egypt as well as Palestinians living under Palestinian rule in the territories. Would that the Arabs were half as careful with the lives of their brothers as Israel has been. And would that the "international community" find its voice to object to Arab treatment of Arab refugees, even if Arabs can't do it themselves. JINSA Report #871 March 20, 2009 News Flash: Fatah Doesn't Recognize Israel According to Mohammad Dahlan, former Fatah Security Chief and current "special advisor" to Abu Mazen, Fatah has never recognized "Israel's right to exist" and said Hamas shouldn't either. "For the one thousandth time, I want to reaffirm that we are not asking Hamas to recognize Israel's right to exist. Rather, we are asking Hamas not to do so because Fatah never recognized Israel's right to exist," he said in a Palestinian television interview cited by The Jerusalem Post. It was the PLO, the umbrella organization, which did so, he said, not Fatah the subsidiary, and Fatah is not bound by the decision. So? "Well," say the indignant, "Israel can't possibly make peace with people who don't recognize its right to exist. The U.S. demands, Mrs. Clinton demands, I say, DEMANDS that Hamas renounce violence and recognize Israel in order to have a Unity Government with Fatah so the U.S. can pour in a billion U.S. tax dollars, put the onus of 'making peace' on Israel and get to the Two State Solution." It is time to repeat the mantra of an American general. "Don't tell me what to do, tell me what you want to have done." Find the end game and then decide how to use resources to get there. In this case, however, the United States is promoting two mutually exclusive end games: a Hamas-Fatah Unity Government and the so-called Two State Solution. For the first, it shouldn't surprise anyone that Fatah is conceding points to what it considers the senior player. To have unity, one side has to give up the contested issues; Fatah, being weaker, did so. That was inevitable result of the United States, Israel and Egypt elevating Hamas to the role of central political player without whom nothing can be done, after Israel had enormously degraded its role as central military player with whom nothing can be done. In that sense, Hamas won and Fatah lost the Gaza war, and as Machiavelli wrote, peace is the set of conditions imposed by the winner on the loser of the last war. Peace/unity between the two is a function of Hamas's conditions. But that is inconsistent with the administration's vision of the Two State Solution: a secure Israel living next to a unified democratic Palestine. The current reality is either that Fatah accepts Israel's legitimacy and Hamas doesn't so there will be no Unity Government, or to believe Dahlan, there is unity in their rejection of Israel. In neither case will a Unity Government accept the legitimacy of Israel's sovereignty in the region.  Furthermore, a Unity Government under Hamas is inconsistent with the American determination that Hamas not receive U.S. taxpayer dollars. A Unity Government under Hamas is inconsistent with the American training of Palestinian security service/military forces loyal only to Abu Mazen and fighting "terrorism" against both Fatah and Israel.   The incoming Israeli government, led by Likud, has said that the Two State Solution is not presently feasible, putting it on the path to direct confrontation with the United States.  It would be wise of the Obama Administration to review its inconsistent policies on unity and statehood, and try to find common ground with Israel on security and economic development for the Palestinian people and for Israel. JINSA Report #870 March 17, 2009 Penny Wise and Disgusting We weren't going to say a word about bank, automaker or insurance company bailouts with taxpayer dollars; economics are not really our thing. But an administration plan to save $540 million by forcing civilian insurance companies to cover claims by military veterans for service-related injuries is beyond the pale. For our government to propose such a scheme at the same time it is spending BILLIONS with not much accountability is disgusting. The idea surfaced in testimony by Veterans Affairs Secretary Eric Shinseki - a retired Army general who should know better. He told a Senate committee that the plan was "a consideration," and that "the VA's proposed budget for next year included it" as a way to increase revenue. But "a final decision hasn't been made yet." President Obama, Secretary Shinseki and Chief of Staff Rahm Emanuel met with a group of veterans' organization leaders yesterday. The American Legion commander said he was "deeply disappointed and concerned" when the President reiterated the plan. The Legion points to several practical problems for the soldiers inherent in forcing their private insurance companies (which are supposed to pay for civilian-related medical care) to pay: Depending on the severity of the medical conditions, maximum insurance coverage limits could be reached through treatment of the veteran's condition alone...leaving the rest of the family without health care benefits. Many insurance companies require deductibles to be paid before any benefits are covered. Private insurance premiums could be elevated to cover service-connected disabled veterans and their families, especially if the veterans are self-employed or employed in small businesses unable to negotiate more favorable pricing. Some employers, especially small businesses, would be reluctant to hire veterans with service-connected disabilities due to the negative impact their employment might have on obtaining and financing company health care benefits. But the real problem is not practical - it is moral, and the Obama Administration appears willing to sell out its moral obligation to our armed forces for $540 million. Words fail us - and regular readers know that words almost never fail us. If there can be $750 BILLION in the TARP program, including $50 BILLION for mortgage bailouts and $85 BILLION for AIG; if the government can spend $25 BILLION bailing out automakers; if Congress can think of EIGHT THOUSAND pet projects on which it wants to spend taxpayer dollars, how is it possible that the White House and VA think wounded soldiers, sailors, airmen and Marines should be asked for additional personal financial sacrifice? Senator Grassley, speaking of AIG and others spending government funds on employee bonuses, said, "The first thing that would make me feel a little bit better toward them if they'd follow the Japanese example and come before the American people and take that deep bow and say, I'm sorry, and then either do one of two things: resign or go commit suicide." He later said he didn't mean that they should actually kill themselves, but rather show some of the shame that the Japanese traditionally show when they have done something egregious. A little of the Japanese example would serve the President and the VA well, too.
