JINSA Report #887 May 21, 2009 Little Changes, Big Changes Roundly discussed before it happened, and furiously spun when it was over, the Netanyahu-Obama meeting left the world curiously unchanged. The President still thinks two states can be fashioned out of the Hamas-run Gaza territory, Fatah-run West Bank territory and the State of Israel. The Prime Minister still thinks they can't - maybe not ever, certainly not now. They agree that Iran with nuclear weapons would destabilize the region and the world but they still don't agree on red lines in the development cycle or a time frame for action. The Palestinians are marginally less happy because there was no apparent increase in a United States-Israel rift on both Iran and the Palestinians that began under the Bush administration. The Iranians are marginally happier because Israel agreed with the President's decision on engagement, and they proved it by launching the solid-fuel Sejil-2 missile yesterday. It seems to be an attempt to overcome problems with the prior launch in November, and proof positive that nothing has changed in Iran. Which is not to say the world is standing still. Check Pakistan and Sri Lanka. President Obama rightly connected progress in Afghanistan to weeding out Taliban bases from the tribal badlands of Pakistan to the southeast of Afghanistan. His Iran outreach was in part based on the need to stabilize Afghanistan to the west. But Pakistan changed. Instead of being a corrupt, nuclear-armed but pro-Western country with a Taliban problem, Pakistan became a potential Taliban-style state with nuclear weapons. The government had reached an agreement with radical forces to permit Sharia law to govern the Swat Valley - over the expressed wishes of local Pakistanis who had voted overwhelmingly for secular politicians - and the radicals swarmed to within 60 miles of Islamabad. The government is now pushing back with American assistance, lots of civilian casualties and tens of thousands of refugees in desperate need of aid. Perhaps the Pakistani government will succeed, but in the best case the country has been seriously weakened for future diplomatic and military activity. Democratic, nuclear-armed India cannot take lightly the possibility of an even more radical Pakistan - and what India doesn't take lightly, neither should the United States. On the other side of India, Sri Lanka also changed. After more than 80,000 lives lost in 25 years of repeated terrorist acts, government retaliation, phony cease fires and "peace" treaties, the Sri Lankan civil war ended the old fashioned way. The government pushed the Tamil Tigers to the coast, cut off their escape and killed as many as they could. The battle was brutal, bloody and involved tremendous civilian suffering. Tens of thousands of refugees are in desperate need of aid. While the United States will likely rush aid to both places - the right and humane thing to do - it would be worthwhile also to consider the nature of our investment in other peoples' civil wars and insurrections. And to consider our standard insistence that governments offer treaties, ceasefires, land and other inducements to radicals and terrorists. And then to consider American insistence that Israel offer treaties, ceasefires, land and other inducements to the Palestinians. JINSA Report #886 May 11, 2009 The Spanish Inquisition Spanish courts function in a way not well understood by Americans. To begin with, prosecutors and judges are on the same team. There is no Grand Jury before which evidence is presented and charges brought or dropped. In addition, Spain has created for itself "universal jurisdiction" that permits judges to try a case involving any country if the Spanish judge decides the country is either not an "acceptable" democracy or didn't do a "good enough" job investigating itself.   Spanish prosecutors considered the case of Israel's 2002 bombing that killed terrorist mastermind Salah Shehade and the 14 civilians Shehade was using as human shields in his home in Gaza. The prosecutors concluded that Israel is a democratic country with an independent judiciary that had properly investigated the bombing, and they recommended that the Spanish court drop the case. [We can't tell you how relieved we were that Spanish prosecutors consider Israel a democratic country!] But the judge decided the Israeli investigation was insufficient and that Spain will try seven Israelis for "crimes against humanity."    Just in case it wasn't clear, the Spanish deputy prime minister is reported to have said, "Spain is a country ruled by law and the justice system enjoys absolute independence."   Spain is also, of course, pursuing war crimes investigations against four American officials regarding conduct during the Bush Administration.    Should the judge issue an international arrest warrant for any of the Israelis involved, or ultimately any of the Americans now being investigated, they could be detained upon arrival in any EU member state. [Or not, if the EU is like the Arab League that ignored the warrant from the International Criminal Court and welcomed Sudan's chief butcher Omar Bashir, who has been indicted for war crimes in Darfur.]    Israeli officials denounced the Spanish decision; one MK suggested indicting Spanish officials for their role in the NATO bombing of Serbia in 1999, during which hundreds, if not thousands of civilians died. American Attorney General Eric Holder, on the other hand, said, "We would look at any request that would come from a court in any country and see how and whether we should comply with it... to the extent that we receive lawful requests from an appropriately created court, we would obviously respond to it."   It is hardly obvious. One could argue that the Spanish court is not "appropriately created" because "universal jurisdiction" by an uninvolved country is actually "unilateral jurisdiction," and, on its face, inappropriate. Further, the criminalization of military activity is a double-edged sword. To some countries, including but not limited to Spain, all military activity by the United States and Israel is potentially criminal.   The idea that a new Spanish Inquisition will be kinder in the future to officials of the Obama Administration, currently pursuing military operations in Afghanistan and Pakistan, than it is to Israel or Bush Administration officials is naïve and dangerous. JINSA Report #885 May 7, 2009 "Don't Worry, We'll Fail"  Is he the Administration's "honest man," or is Defense Secretary Gates sabotaging the President's overtures to Iran? If the first, it speaks volumes about his influence in policy-making that Mr. Gates went abroad to tell our Middle Eastern friends that he expects no dramatic changes in U.S.-Iranian relations. If the second, well, sigh. Egypt - along with Saudi Arabia and several of the Gulf States - has been worried that the Administration's overtures to Iran would encourage Tehran to believe it could engage the United States without halting or slowing its nuclear program or its support of Islamic (Shi'ite and Sunni) terrorism in the region. Mr. Gates clearly meant to be reassuring. According to published reports, Mr. Gates said in Cairo, "I believe that kind of prospect is very remote. We'll just have to see how the Iranians respond to the offer from the president. Frankly, some of the first things that have happened as a result of the extension of that open hand have not been encouraging... To tell you the truth, I have been around long enough to see these efforts attempted before with no result. The question is whether circumstances in Iran have changed in such a way that with the administration offering an opportunity for contact that the Iranians are willing to take advantage of that opportunity." Mr. Gates said progress with Iran would come slowly, if at all. He probably reassured the wrong people. Iran needs nothing so much as time - coupled with financial, energy and dual-use technology assistance from Germany, North Korea, China and Turkey (and gasoline provided by European refineries) - to advance its plans both for nuclear capability and the destabilization of rival countries. (Rival countries include not only Israel, but also Saudi Arabia and Egypt for historical and religious reasons.) The U.S. rebuke of Israel for considering a military option, coupled with the President's comments that only if his open hand policy failed would the United States consider additional sanctions against Tehran, plus Mr. Gates's public acknowledgement that progress would be slow, should reassure the mullahs that everything is on track.   Mr. Gates's long experience in Washington gives him good reason to be skeptical of Iran; we concur in his assessment. But he works for President Obama now, who probably believes that his encouragement of Tehran will, indeed, work. There is no reason to believe the President is being cynical when he says he wants to change the paradigm of U.S.-Iranian relations. We think the policy is wrong - but we don't think the President is insincere. What does the President think the Iranians think when the President makes them an offer with one hand and his defense secretary dooms the initiative in the capital of a chief rival?   The Iranians aren't cynical either. They are most straightforward in their belief that the Revolution is succeeding and that their twin goals - nuclear capability and Persian Shi'ite domination of the region - are the reason they are on this earth. The apparent split within the Administration, plus the split between the United States and its Middle Eastern allies including Israel, leaves the West in a weakened position. JINSA Report #884 May 6, 2009 Iran is Not Only Israel's Problem  Secretary of State Clinton (echoed by Rahm Emmanuel) told Congress, "For Israel to get the kind of strong support it's looking for vis-a-vis Iran it can't stay on the sideline with respect to the Palestinian and the peace efforts, that they go hand-in-hand." She added Arab officials want "very much to support the strongest possible policy toward Iran." But, "they believe that Israel's willingness to reenter into discussions with the Palestinian Authority strengthens them in being able to deal with Iran." First, the ridiculous. The regional anti-Iran axis includes Saudi Arabia, Egypt, Jordan, Kuwait, Bahrain, Morocco and parts of Lebanon. All acknowledge the threat posed by Iran (and the coincidence of interest with Israel) and none is able to deal with Iran. They are friends of the United States who previously looked to Washington for leadership. Now, Saudi Arabia and some of the Gulf States, worried that the administration's overtures to Teheran will strengthen the mullahs, are accommodating themselves to increased Persian influence.    Egypt, perhaps less so. David Schenker in The Weekly Standard notes, "Egypt may finally be taking steps to reestablish itself as a counterweight to a resurgent Tehran... Egyptian authorities announced the arrest last November of dozens of Hezbollah operatives in the Sinai... accompanied by unprecedented Egyptian condemnations of the Iranian-Syrian backed organization and its popular leader, Hassan Nasrallah. The arrest and subsequent war of words suggest an effort may be underway by moderate Arab states to roll back the increasingly pernicious Persian influence in the Levant."  Secretary Gates' comments in Cairo yesterday were clearly designed to allay Egypt's fears. Then, the incomprehensible. There are daily Israeli "discussions" with the Palestinian Authority on security and economics, and the Netanyahu government pledged to continue and increase them. On the larger "final status" issues, Mrs. Clinton has been pushing desperately and unsuccessfully for a Hamas-Fatah unity government. Khaled Abu Toameh writes in The Jerusalem Post, "Talks... failed after it became evident that the Islamist movement remained unwilling to make the slightest concession. According to Fatah representatives, the Hamas negotiators made it clear... they would never recognize Israel's right to exist or the Oslo Accords and other agreements between the Israelis and Palestinians. Moreover, the Hamas team emphasized their movement's 'right' to continue 'resistance operations' (including rocket attacks and suicide bombings, of course) against Israel. Mahmoud Abbas and Hosni Mubarak are reported to be extremely angry." They should be angry with Mrs. Clinton for trying to force a deal that would undermine Abbas at home and Mubarak in the region by courting Hamas. Toameh quotes a senior aide to Abbas, "Hamas should be weakened, not strengthened. Hamas is not going to relinquish its radical policies as long as it feels that the Americans and Europeans are prepared to deal with it without demanding anything in return." Finally, the obvious. Iran should not be framed by the United States as Israel's problem.  President Obama has been quite clear that Iran's advancing nuclear capability is a threat to the United States and to our regional friends and allies. Mrs. Clinton should be looking for additional support for stopping Iran - not throwing Israel, Egypt and Abu Mazen overboard while she chases Hamas and the ephemeral two-state solution. JINSA Report #883 Jack Kemp

JINSA Report #883 May 4, 2009 Jack Kemp The Officers and Board of JINSA note sadly the passing of the Hon. Jack Kemp, a longtime member of the JINSA Board of Advisors, a great friend and a great supporter of Israel and America's democratic allies around the world. Mr. Kemp received JINSA's Henry M. Jackson Distinguished Service Award in 1985. Everyone in Washington has a favorite Jack Kemp story - we are no different. For JINSA, it was an evening in early June 1982 at the beginning of Israel's Operation Peace for Galilee - a response to months of Katyusha shelling by the PLO of Kiryat Shemona and the northern Galilee. At the beginning of OPG, there was a news "greyout" which the PLO filled by announcing 10,000 civilian casualties and Israeli "war crimes" against the Palestinians and the people of Lebanon. The New York Times called the IDF movement toward Beirut a "blitzkrieg," inveighing against Israel for the first time, but not the last, with images of Nazi brutality.   JINSA held a meeting with Jack as the featured speaker. The room was crowded and the crowd was nervous and unhappy. "What if all the bad press was true?," people asked each other in hushed tones. "What if Israel had overreacted?"  The first thing Jack Kemp did was admonish us in no uncertain terms. "How can you say this; how can you think this? You can't possibly believe that Israel has abandoned its moral and democratic foundation. This is the IDF we're talking about. Where is your faith in the Israel you know?" Jack Kemp never lost faith in the Israel he knew, and he was shortly proven right.   Much was made of a purported meeting during the term of President Bush (41) in which a certain cabinet secretary was said to have denigrated the American Jewish community in language best described here as "salty." Jack was then secretary of the Department of Housing and Urban Development (HUD) [where he coined the term "bleeding heart conservative," a forerunner of the "compassionate conservatism" of President Bush (43).] Shortly after that meeing, two members of JINSA's professional staff paid a call on Jack in his HUD office. There, prominently displayed on a banquette was the large, swooping, porcelain eagle JINSA had presented to him in 1985. We were pleased to see it, and more pleased when he a) affirmed the content of the meeting while b) assuring us that he was there and the cabinet secretary did not go unanswered. Reviewing this piece for publication, JINSA's Executive Director Tom Neumann was unhappy.  "It lacks the love Jack deserves," he said.  We share Tom's thoughts: While many gave ideas to conservatism, Jack also sought to give character to conservatism.  He was as much a defender of minority rights and equality, and had as much compassion and as much concern for justice as any liberal.  He was a peer to even Jesse Jackson as a defender of civil liberties.  His commitment to Israel was born out of his passion for justice.  At the same time he was an advocate of fiscal and personal responsibility, a champion of entrepreneurship and of capitalism. He was American - first, last and always - and he understood better than most what made America great.  He will be missed because there are no more Jack Kemps to be seen on the contemporary stage. Liberal and conservative, we are all poorer for having lost him. We, in JINSA, will miss him.
