The Patriot Act and Interpol

Before leaving town, the House and Senate agreed to a 60-day extension of provisions of the Patriot Act set to expire at the end of the year.  When they return they will take up the separate House and Senate versions of the bill that would reauthorize the full Patriot Act through 2013.
 
The three key  - and sometimes controversial - provisions extended are known as the "lone wolf," "business records," and the "roving wiretap." 
  • The "lone wolf" allows the government to track a non-American suspect who has no discernable tie to a terrorist group or foreign power.  It appears never to have been used in a FISA application (FISA is the Foreign Intelligence Surveillance Act that governs national security related warrants). 
  • The "business records" provision allows the government to compel third parties (telephone companies, banks, etc.) to provide them access to a suspect's record without notifying the suspect.  The FBI told the Senate that the "business records" provision had been used just over 200 times between 2004 and 2007.
  • "Roving wiretaps" allow investigators to apply one FISA court warrant to all forms of electronic communications used by the suspect (phone, cell phone, BlackBerry, home computer, etc.) but only if the government can show that the suspect is switching devices to evade detection.  The government has applied for roving wiretaps an average of 22 times a year since 2001.
The numbers repudiate the notion that the government is in wholesale violation of the civil liberties of Americans and despite his previous denunciation of the Patriot Act, President Obama has publicly supported the reauthorization with the inclusion of these three provisions. We hope Congress returns able to make the case that the government has been - and will remain - able to balance security and civil liberties while we are at war.
 
On the other hand, as regards civil liberties, before leaving town, President Obama issued a worrisome Executive Order regarding Interpol, the international law enforcement organization headquartered inside the Justice Department.  

In 1983, President Reagan gave Interpol elements of diplomatic status, subject to constraints; the most important being that Interpol's property and assets remained subject to search and seizure, and its archived records remained subject to public scrutiny under provisions including the Freedom of Information Act.  President Obama's brief Executive Order (100 words including the full title of Interpol) removes the Reagan limitations. 

Interpol's files and assets are now inviolable while it conducts operations in the United States that affect Americans and American interests.  Former federal prosecutor Andrew McCarthy notes that Interpol works with foreign courts including those in Europe that are investigating the Bush administration for purported war crimes, and asks, "Why is it suddenly necessary to have, within the Justice Department, a repository for stashing government files which... will be beyond the ability of Congress, American law enforcement, the media, and the American people to scrutinize?"

"Why would we elevate an international police force above American law? Why would we immunize an international police force from the limitations that constrain the FBI and other American law-enforcement agencies?"

Good questions.  Congress might want to consider them when they address the civil liberties questions arising from the Patriot Act.

We Are Fighting a War Against Terrorists and the States that Harbor and Support Them

President Bush was right. There. We said it and we'll say it again. President Bush was right that the war in which the West is engaged is the war against terrorists and the states that harbor and support them. 
 
President Bush's formulation was a sea change from the Clinton Administration's law-enforcement approach that worked to apprehend people and understand the process after the fact. The Bush formulation was also rejected by President Obama, whose Homeland Security secretary's first instinct after the Christmas day airline bombing attempt was to say that "after the incident" the system worked vey well. OK, Secretary Janet Napolitano recanted, but still, she is the one who brought you "man caused contingencies" because she couldn't bring herself to say "terrorism."
 
President Obama remains focused on stopping individuals who "break the law." He has asked for a review of the "terrorism watch list" containing the names and aliases of some half a million persons.
 
A notably liberal columnist in The Washington Post wrote today that, "Our enemy apparently sees its future in places such as Yemen-or perhaps Somalia, a failed state for almost two decades...The enemy's leadership is believed to be ensconced in remote areas of Pakistan...yet the United States will soon have about 100,000 troops chasing its shadows in Afghanistan, where al-Qaeda's presence is now minimal."
 
But the liberal columnist couldn't connect the dots - a common failure among those who don't choose to understand. The connection is that states that do not control their territory and states that hate the West are places that terrorists find haven, money, training, passports and airline flights. Iran, Syria and the Palestinians in both the West Bank and Gaza do it on purpose. Pakistan, Yemen, Afghanistan and Lebanon don't control their territory entirely - and maybe don't want to. 
 
The liberal columnist didn't say it, maybe didn't understand it, and surely wasn't about to give credit where it was due.
 
Al Qaeda was in Afghanistan before, but it left when the United States toppled the Taliban that gave it sanctuary. Al Qaeda was in Iraq, but it left when the United States deposed Saddam and helped the Iraqis build a governmental structure that controls all the parts of the country - without rape rooms and mass graves. The United States has been helping Yemen dispose of the al Qaeda presence that lives in the areas that are relatively remote and ungoverned. According to American military sources in Iraq, Syria has become a haven for al-Qaeda. 
 
This is not a plea to invade any additional countries, but to understand the sources of the problem and determine which countries can deal with it themselves, which ones we need to help and which are-determinedly-our enemies and need to be dealt with as such.
 
Stripping airline passengers is the last stage of failing to address the problem. Looking for one individual in the terrorism watch list database and thinking you can stop him (or her) is ridiculous. We are lucky in the extreme that brave and vigilant people sometimes pop up to stop individuals committing or trying to commit acts of terrorism. We are lucky in the extreme that parents are beginning to come forward to express concerns about their own children. But we will never stop all the individuals who seek to do us harm.
 
That is what the Israelis understood when they went into the West Bank in 2002 to wipe out the Palestinian terrorist infrastructure and reclaim control of the territory from which terrorism came to Israel during the so-called "second intifada." That is what the security fence and checkpoints do. That is what the Israelis understood when they launched Operation Cast Lead against Hamas in Gaza one year ago. 
 
They couldn't stop all the individuals; they had to control the space.
 
That is what President Bush understood. And he was right.

The Dangers We Face

It was bad enough that United States agents failed to take seriously the visit by Umar Farouk Abdulmutallab's father, a prominent banker, to the U.S. Embassy in Nigeria to report his concerns about his own son's associates and behavior. It was bad enough that spokesmen for the U.S. government later said the father's concerns, "didn't rise above the level of noise." It was bad enough that after the attempt to blow an airliner out of the sky with more than 200 people aboard was thwarted only by the brave instinct of a passenger, Secretary of Homeland Security Janet Napolitano said that all the security systems worked (a statement she was forced by public ridicule to recant). And it certainly was bad enough that the U.S. government moved first to its default position that Abdulmutallab was a lone actor, not a card-carrying member of a terrorist group. 
 
And it was unfortunate that when President Obama finally made a public statement three days later, the best he could do was note that, "This was a serious reminder of the dangers that we face" and "It's absolutely critical that we learn from this incident."
 
The danger we face is jihadist ideology which glorifies the killing of Americans and other Westerners, and what we should learn is that the "war against terrorists and the states that harbor and support them" was not a figment of the previous administration's imagination.  
 
Because of the insistence of the Obama Administration that the dangers we face are simply individual criminal events, Abdulmutallab has been charged with a federal criminal complaint comprised of two civilian crimes-trying to destroy a plane in U.S. airspace, and bringing a "destructive device" on an aircraft. They are felonies, carrying penalties of up to 20 years in prison and a fine of up to $250,000. No mention of terrorism. According to some legal experts, these charges are "place keepers" to allow the government to detain Abdulmutallab while the investigation continues.
 
The implications, however, are immediate and grave.
 
Counterterrorism expert Steven Emerson, interviewed right after Christmas said, "I'd like to first find out who recruited him. I'd like to find out where he got the explosives. I want to get the signature of the bomb, which is now being determined by forensic investigators at Quantico. I'd like to find out who sent him. How he was recruited. Those are all things they may find out, obviously, through the interrogation of him, plus a review of his cell phone records, his travel records, his computers, or laptop if they can retrieve it. Interviews with his colleagues, his friends, or whatever. And now a review of his national security records over the past year to see whether he actually came into the United States ahead of time, as they think he did, to do a reconnaissance mission to determine the feasibility of carrying out such an attack."
 
We would want to know those things as well. But being charged in a U.S. court means that Abdulmutallab is now entitled to Constitutional protections, including the Fifth Amendment protection against self-incrimination. And we are sure that if Abulmutallab doesn't know about those rights, his court appointed lawyer or the ACLU will surely tell him. How much we will learn from him under the circumstances is unclear.
 
We have already learned enough about the young men-from the United States, from Nigeria, from Pakistan-who adopt jihadist teachings as their religious touchstone to understand that it is a mistake to endow terrorists with the legal and constitutional rights of American citizens who violate civilian laws. 
 
The United States and the West are at war and it is that of danger the President should consider himself to have been reminded-mercifully, without anyone being killed.

[Note: at the Sunday funeral of the three men, thousands of Palestinians chanted anti-PA slogans, accusing the Palestinian Authority of "collusion" with Israel to arrest, disarm and kill Fatah military operatives. A largely unreported story is the unhappiness of Palestinians with the ruthlessness of the PA security forces in hunting down its internal enemies-Hamas, to be sure, but recalcitrant Fatah members and others as well. The United States and international "human rights" organizations have been completely and utterly silent about vicious abuses taking place inside the PA. It may be that the Palestinian public is reaching the limits of its patience with its own security force.]
 
On Thursday, three Palestinians murdered teacher and father of seven Rabbi Meir Chai in the West Bank. On Friday, Israeli forces surrounded the Nablus homes of the three suspects, all members of Fatah's al-Aksa Martyrs Brigade, and demanded they surrender. Israeli intelligence had identified the men and cautioned that all three were armed. One came out holding his wife in front of him. The second refused to come out of his house, which was filled with family members. The third went to his attic and was shouting "Allah Akhbar" as the Israelis came upstairs. All three, but no others, were killed.
 
According to Ha'aretz, the Obama Administration, acting on complaints from the Palestinian Authority, requested that Israel "explain." The Palestinians had asked the United States to condemn the raid as a violation of Palestinian authority in Area A, saying Israel should have asked the PA security forces to arrest the three. American officials received both the intelligence information and the details of the operation, and thus far at least, the administration has declined to offer an opinion.  
 
Which is wise, as there are bigger issues at play here.
 
The Israeli government recently announced a (partial) "settlement freeze" and appears interested in a modus operandi with the Obama Administration to restart formal talks with the Fatah-led PA. Israeli citizens living east of the 1949 Armistice Line are increasingly edgy about their future in their homes. For the Palestinians, any apparent lessening of Israeli government support or protection for its own citizens has always appeared as license to attack. [After Israel withdrew unilaterally from Lebanon in 2000, Palestinian attacks on the West Bank increased throughout the spring until Fatah's Yasser Arafat opened the throttle on the full-scale terror war known as "the second intifada" in September.] And indeed, shooting and stabbing attacks against Jews on the West Bank have increased in recent weeks, culminating in the death of Rabbi Chai.
 
This presents a problem for the United States and for Israel. 
 
Both have been touting the emergence of American-trained Palestinian "security forces" as a means of securing the West Bank against Hamas, and part of institution building for the Palestinians. JINSA had previously questioned the long-term loyalty of such a force, but this weekend's operation shows the other side of the risk. It is one thing to accept that Fatah forces will hunt down Hamas forces that threaten them-it is another to expect Fatah forces to take seriously the day-to-day security of Israelis living on the West Bank. It is Fatah's fixed position that those people have no right to be where they are and they will not be part of the future of the territories.
 
Israelis have seen revolving door Palestinian "justice," and since all three suspects in the killing were products of Fatah's own al-Aksa Martyrs Brigade, there was no reason to believe any Fatah arrest of the three would be anything other than temporary.
 
As a matter of day-to-day policing, Palestinian security forces have proven to be able to bring safety and security to local residents, allowing them greater freedom to improve their lives. As a matter of Hamas-hunting, the security forces will clearly work to protect themselves from Hamas, and use it as cover to eliminate other internal opposition. But as a matter of the safety of Israeli citizens living in disputed areas, security for Israelis has to come from Israel.

The company had planned to invoke the abandoned property decree of the company to confiscate the funds after the expiration of the period given to me, Also I have received official letters in the last two days suggesting a likely proceeding for confiscation of his abandoned personal assets in line with existing laws of the institution.
Well I have reasoned very professionally and I can use a legal means to present a next of kin of my deceased client. This is legally possible and would be done in accordance with the laws of the land. I do sincerely sympathize the death of my client but I think it is unprofitable for his funds to be submitted to the government of Thailand or some financial institution,  My aim is to retrieve this funds and let it be claimed by the deceased family, etc. for this I seek your assistance since I have been unable to locate the relatives for the past 5 years now.
I seek your consent to present you as the next of kin of the deceased so that the proceeds of this account can be paid to you and then both of us can share the money, 60% to me and 40% to you.
