JINSA Report #857 February 11, 2009 Go Israel A-Sharq Al-Awsat London's pan-Arab daily wrote, "Israeli elections: Between the Right and the extreme Right." The Palestinian Al-Quds opined, "We're witnessing the Israeli rivals in the election campaign outbidding each other in ultra-extremism, as a way to gain more votes. Israeli society has turned more extreme, and moved much further from peace and its obligations." Time magazine screamed, "Israel Election Dashes Hopes for Peace." Not really. The close split between Kadima and Likud (early results without soldier ballots) may indicate that the Israeli public has coalesced toward the center, which even Time admits - but worries that the "mutual antagonism of both leaders" (the mutual antagonism of one of them wouldn't have been interesting) which "makes an accommodation all but impossible." Like, say, campaign antagonism between Hillary Clinton and Barak Obama? But, for the sake of argument, what if the Israeli public has really moved one or two or more steps to the right? What then? Perhaps the pundits should consider what made them move and how to move them back, if back is where they need to go. Israel is, after all, a democracy; a multiparty, open system with a free press and an informed electorate. The Israeli public has a voice and knows how to use it. Who influences it and how? Israelis listen not only to their own leadership, but also to that of Hamas, Hezbollah, Syria and Iran - and watch what they do to threaten Israel and to poison their own people.  Israelis listen to public demands by Egypt, Jordan, Saudi Arabia, Oman and Bahrain - and know they all admit in private that they want Israel on their side against Iran. Israelis listen to the EU, the United States and the Quartet - and read the Oslo Accords, Gaza-Jericho, Oslo II, the Wye River and Hebron agreements, Taba and the Road Map, and wonder why asymmetrical paper agreements that require Israel to provide tangible benefits to the Palestinians in exchange for promises of security for Israel have not resulted in security for Israel.   And they become skeptical of more talk and more hard concessions in exchange for empty promises. Skepticism is reasonable. Perhaps Palestinian "[t]ermination of all claims or states of belligerency and respect for and acknowledgment of the sovereignty, territorial integrity and political independence of every State in the area and their right to live in peace within secure and recognized boundaries free from threats or acts of force," would incline Israelis to take a more "dovish" approach.   Interestingly, while clearly discouraged on the "peace front," Israelis appear not to have become skeptical of the importance of actually BEING one of only two countries in the region that can claim free, open, non-coercive multiparty elections (and one of them hasn't been at it very long).   Israel has not spent a single day, a single moment, in peace with its neighbors. Israel has not had a single day or a single moment in which it was not threatened with extinction - Iran is only the latest existential threat; in 1967, the rabbis were talking seriously about religious rituals that would be observed if Israel was forced to use the mass graves it was preparing for its citizens. Under the circumstances, the Israeli public - center right or center left as the vote falls - deserve a cheer from small-d democrats around the world for another peaceful exercise of a precious franchise. JINSA Report #856 February 5, 2009 Erdogan at Davos The situation in Turkey is going from bad to worse. Last week at Davos, Turkish Prime Minister Recep Tayyip Erdogan showed his true colors when he barged out of a meeting with UN General Secretary Ban Ki-moon, Arab League head Amr Musa and Israel's President Shimon Peres. The incident occurred after Shimon Peres presented Israel's position on Gaza in response to Erdogan's practically hysterical diatribe against Israel. "When it comes to killing you know well how to kill," Erdogan yelled at Peres, a Noble Peace Prize recipient. For the past several weeks Erdogan had been mounting an anti-Israel campaign so vicious that it fostered a convulsion of the vilest anti-Semitism directed at the Turkish Jewish community ever seen in that country. Why did this happen now? Erdogan's handlers would claim that the casualties in Gaza moved him, but the prime minister was also aware of the thousands of Hamas rockets and mortar bombs Israel endured for months without response. Nobody needs to explain to the Turks what it means to be a constant target of terrorism. Nobody needs to explain to the Turks the necessity of being unyielding in their response to terrorism. They wrote the book on it. So why did Turkey take this anti-Israel turn now? The Turkish press reported that it was Erdogan who requested the Davos panel suggesting that the dramatics were premeditated. Observers note that electioneering had already begun in anticipation of the March 29 municipal elections in Turkey. Ever since his election in 2003, it has been Erdogan's intention to steer Turkey away from Kemalism and hurl the country back to its Ottoman glories. Erdogan also learned from the mistakes of the earlier failed Islamist Welfare Party government of Necmettin Erbakan. Erbakan tried to implement his Islamist reforms too quickly and was forced out by the Turkish military in 1997. A shrewd politician, Erdogan learned two lessons from Erbakan's ouster. The first was that change would have to be gradual. The second was that the military would have to be neutralized. In both he has succeeded. What the world saw at Davos was an Erdogan confident enough in his consolidation of power to act. Erdogan's two weeks of hostility to Israel, Turkey's stalwart friend and trading partner, served notice that he was putting himself and his country on the side of Iran, Syria and Hamas against the more pro-Western Egypt and Saudi Arabia. And how better to consolidate his vision than to stir up hatred against one of Turkey's most modern Kemalist elements - the Jews? JINSA Report #855 February 4, 2009 Creating Countries at the ICC In 2002, JINSA opposed the creation of the International Criminal Court (ICC). (JINSA Reports #265 & #266). The ICC is not required to provide Americans the basic legal protections guaranteed to us by our Constitution, and has nebulous political goals including "to achieve justice for all," and "to end impunity (of national leaders)." We called it a "playground for mischief" and "UN groupthink," and said Israel and the United States would be the primary targets of its political judges.   But a few weeks ago, we found ourselves citing ICC prosecutor Luis Moreno-Ocampo on the doctrine of proportionality: The death of civilians during an armed conflict, no matter how grave and regrettable, does not in itself constitute a war crime. International humanitarian law and the Rome Statute permit belligerents to carry out proportionate attacks against military objectives, even when it is known that some civilian deaths or injuries will occur. [Military objectives are] those which by their nature, location, purpose or use make an effective contribution to military action and whose total or partial destruction, capture or neutralization, in the circumstances ruling at the time, offers definite military advantage. Forbidden, he wrote, would be: An intentional attack directed against civilians or an attack launched on a military objective in the knowledge that the incidental civilian injuries would be clearly excessive in relation to the anticipated military advantage... (or) intentionally launching an attack in the knowledge that such attack will cause incidental loss of life or injury to civilians or damage to civilian objects... clearly excessive in relation to the concrete and direct overall military advantage anticipated. Israel met the first condition; Hamas the second. And since Moreno-Ocampo wasn't writing about Israel and Gaza, we thought we were safe citing him. We should have known better. Having first said the ICC had no jurisdiction over Israel (which, like the United States, is not a signatory to the treaty that established the court), Moreno-Ocampo told The Times (UK) that he is considering "the case for Palestinian jurisdiction over alleged crimes committed in Gaza." Palestinian groups say Gaza is a de facto state, despite its lack of recognized status. Moreno-Ocampo has agreed to make a finding of status to sue.   If he makes "Palestine" a country, will he also snap his fingers and end the Hamas-Fatah civil war? Otherwise, how will he decide who gets to exercise the new status? It matters in part because Fatah has just accused Hamas of war crimes, publishing a list of people killed, maimed, beaten or tortured BY HAMAS in Gaza. The Palestinian news agency Ma'an cites a senior official saying Fatah is responsible for, "initiating the proper legal procedures against those responsible for the crimes and anyone who gave the directives for murder or torture. These people must be brought to justice." In the International Criminal Court?   The ability of the ICC to make legal trouble is clear. If it arrogates to itself the ability to create countries (or un-create them if it believes Palestine is entitled to the space occupied by Israel) we fear no one will put the breaks on internationalism run amok. JINSA Report #854 February 3, 2009 Israel Did NOT Hit An UNRWA School In Gaza That needs to be the headline somewhere, and we were sure it wouldn't be in the New York Times or The Washington Post. The story itself bears scrutiny; not least because the International Criminal Court is trying to figure out how to make "Palestine" a "country" to give it status to sue Israel for war crimes (more on that later). The first thing we know is that Israel's operation in Gaza was a response to continuing Hamas fire directed at Israeli civilians - a Palestinian war crime. During the operation, an Israeli bomb hit a street near an UNRWA school and a large number of people were killed. We also know that Hamas put its explosives, mortars and rocket launchers amid the civilian population, inside mosques and under civilian buildings. To understand the ubiquity of this second Palestinian war crime (there are others), go to The Intelligence and Terrorism Information Center (www.terrorism-info.org.il) and find the report, "Using the Civilian Population of the Gaza Strip as Human Shields: Aerial photographs show the location of terrorist bases and weapons in the heart of the Gaza Strip." Enlarge the pictures until you can really see the tentacles they wrapped around the people, making them human shields (yet another war crime). Palestinians are no longer reticent to explain. One man told The Washington Post his family lived next door to a soccer field from which Hamas fired at Israel, but he thought the Israelis wouldn't hit his building. "They can tell the difference between a rocket launcher and an apartment." His confidence is touching, if naive. John Ging, UNRWA's operations director in Gaza, is not naïve; he is complicit. He knows Israel didn't hit the school, but he makes it Israel's fault. "I never said anyone was killed in the school. Our officials never made any such allegation. (This is patently untrue; an official UN report three days after the attack said, "Israeli shelling directly hit two UNRWA schools.")  I know no one was killed in the school," Ging told The Jerusalem Post. "But 41 innocent people were killed in the street outside the school. Many of those people had taken refuge in the school and wandered out onto the street. The State of Israel still has to answer for that. What did they know and what care did they take?" What did Israel know? Is Ging suggesting that Israel deliberately dropped a bomb on a street full of civilians? Israel warned Palestinians in Arabic before they attacked, urged them to take shelter or leave the area. Oh, right, they DID take shelter - in the school - according to Ging. The school Israel DIDN'T hit. Question for Ging: why were they "wandering" on the street and how does he know they were "innocent"? Maybe they weren't and maybe they weren't civilians, either. See the outstanding report by Steven Stotsky for CAMERA, analyzing casualty figures from Palestinian sources to conclude that males, aged 15-40 (prime combatant age for Hamas, but violating the Geneva Convention on Child Soldiers), were heavily overrepresented on casualty lists. What care did Israel take? Israel didn't hit the school. But that won't help when politically motivated prosecutors at the political International Criminal Court get ready to strike. JINSA Report #853 January 30, 2009 "The Choice Is Ours" "The choice is ours," is the loose translation in The Washington Post of a comment made in Baghdad before Saturday's vote. More than 15 million Iraqis will choose from 14,400 candidates on 400 lists for 440 seats on provincial councils. The Post story interviews several people ready to take possession of their fractious country (at least in 14 of 18 provinces) and notes that "elections have now won an enthusiastic if grudging fealty, emerging as a true arena for contest in which nearly every sect, ethnicity and tribe in the country has staked its future." Says one Baghdadi, "My sense and the sense of people I talk to is that if they don't vote, then they're responsible for a situation that stays bad." What more could small-d democrats ask? The Post, one of the most important newspapers in the United States, has finally acknowledged that in the secure space the U.S.-led surge has produced, the Iraqi people have agreed that voting beats killing. The story even acknowledges what promoters of democracy have always known, that in an open political system, alliances will change and coalitions will emerge. A Sunni politician said, "Everyone knows the political map will change, definitely. Everyone is waiting to see the results to rearrange their papers and to set up their alliances for the next elections." It's a good thing didn't listen when Harry Reid said the war was lost. Or when then-candidate, now-President Obama said the surge had failed. Even now, The Post hedges - "In some ways, (elections) have revealed a landscape perhaps more precarious than the one the United States inherited in 2003."  Certainly there remains in Iraq sectarian problems and elections are not a panacea - in fact, three Sunni candidates were assassinated this week, which probably shows the fear of those unwilling to present themselves to the public for a vote. But even at that, it is hard to imagine how freely contested elections make a country more precarious than Saddam's torture rooms, mass graves and the poison gas he used against the Kurds and the Shiite Marsh Arabs.   Dictators definitely present the advantage of a single address for all issues, but that is an advantage that accrues only to outsiders, not to the people who have to live under them.  It is hard to imagine that Iraqis would trade their messy, fractious but free and competitive elections for a return to the terror of Saddam. Slipping a look across Iraq's border to Iran, where a clique rather than a single person runs the dictatorship, one wonders how the Iranian people understand the burgeoning freedom of their neighbor next door. Or whether people ruled by Bashar Assad, Hosni Mubarak, Moammar Qaddafi or the corrupt cadres of Hamas, Hezbollah or Fatah wonder what it would take to produce clean, open, multiparty elections in their prisons. We are reminded of the question put to Benjamin Franklin, "Well, Doctor, what have we got - a Republic or a Monarchy?" To which Dr. Franklin replied,  "A Republic, if you can keep it." The Iraqis will have to work hard to keep their new system, and they still need American support, but they have proven they can build a system to keep.
